TBATECH operates institutional ERPs, academic management nodes (such as TBA Alpha), and bespoke cloud software. We implement strict zero-knowledge segregation and adherence to the Digital Personal Data Protection (DPDP) Act, 2023.

1.1 Classification of Data Collected

During the provision of technical services, TBATECH records and processes:

• Direct Administrative Data: Name, designated contact phone number, official email address, institutional designation.
• Institutional & ERP Records: School/organization name, student registers, fee heads, enrollment statistics, attendance snapshots provided directly by the client.
• Security & Network Telemetry: IP addresses, browser agent stamps, access timestamps, authentication session IDs, and administrative change logs.

1.2 Processing Purpose & Zero-Sale Guarantee

Data collected is utilized exclusively for software licensing, role authentication, transactional invoice dispatch, ERP bug resolution, and anti-DDoS security. TBATECH enforces an absolute zero-monetization policy: under no circumstance is client or student data sold, leased, or rented to data brokers or third-party advertisers.

1.3 Cloud Encryption & Automated Backups

All institutional databases and file attachments are stored with encryption at rest (AES-256) and TLS 1.3 in transit. Incremental server-level snapshots are maintained solely for disaster recovery.

2.1 Non-Refundable Scope

Because software deployment, dedicated server provisioning, and custom module coding entail irrecoverable engineering hours and cloud infrastructure costs, all advances, milestone payments, setup charges, and annual/monthly maintenance fees are 100% Non-Refundable. No chargebacks or cancellations will be honored due to client-side delays, operational change of mind, or third-party disputes.

2.2 Pending Dues & Immediate Service Suspension Clause

Clients are obligated to clear invoices on or before the due date mentioned on official billings.

2.3 Late Payment Penalties

Overdue balances beyond the maturity date are subject to an administrative late surcharge of 2.5% per month plus a fixed reactivation fee for restoring locked database partitions.

All software architectures, source codes, algorithmic schemas, UI/UX designs, database models, and modular assets developed for TBATECH products (including TBA Alpha and custom ERPs) remain the sole, exclusive intellectual property of TBATECH.

3.1 Limited Right to Use (SaaS Only)

The client is granted only a temporary, non-exclusive, non-transferable license to use the hosted software for valid institutional purposes during the period of fully paid subscription. No ownership of code is transferred.

Services are provided strictly on an "As-Is" and "As-Available" basis. TBATECH builds high-availability setups, but disclaims direct liability for downtime caused by upstream third-party cloud infrastructure (e.g., AWS, Firebase, Google Cloud, Cloudflare, telecom fiber outages, or local electricity failures).

Under no circumstance shall TBATECH be liable for indirect commercial damages, missed student admissions, or lost profits. Total aggregate liability for any operational fault shall never exceed the monthly fee paid for that single month.
